Scope of Services

The Merchant provides adventure and recreational services, including:

  • Water-based activities: Water Park (Wibbit), Jet-ski (Tours & Rental), Parasailing, Flyboard
  • Land-based activities: Buggy and Quad Safari tours

Booking and Conclusion of Contract

The contract is concluded once payment is authorised. All bookings are final for the selected date and time. The Merchant operates group/shared tours where multiple participants may join the same session, unless a private tour is specifically agreed upon.

Before concluding the contract, the Customer confirms that they have received, read and understood these Terms of Sale on a durable medium (by email). A booking confirmation containing full pre-contractual information in accordance with Articles 57 and 58 of the Croatian Consumer Protection Act (Official Gazette 19/22) will be sent to the Customer’s email address.

Prices and All-Inclusive Equipment

  • Currency: All prices are in Euro (EUR), inclusive of applicable VAT as required by Croatian law.
  • What’s Included: The price covers fuel and mandatory safety equipment (helmets for land activities, life jackets for water activities). No additional fees for basic gear apply at the location.
  • Payment Security: Payments are securely processed via CorvusPay. The Merchant does not store credit card data.

Right of Withdrawal

In accordance with Article 79(1) of the Croatian Consumer Protection Act (Official Gazette 19/22) and Article 16(l) of the EU Consumer Rights Directive 2011/83/EU, the right of withdrawal does not apply to contracts for leisure services where the contract provides for a specific date or period of performance.

By confirming their booking, the Customer explicitly acknowledges and accepts that they waive their 14-day right of withdrawal, as the booking relates to a service with a fixed date and time of performance.

Important notice: The Customer is required to actively confirm (by ticking the appropriate checkbox during the payment process) that they are aware of and agree to this provision. Without this confirmation, the booking will not be processed.

Licensing and Legal Responsibility

By confirming a booking, the Customer acknowledges the following:

  • Driver Requirements: Drivers of Buggy, Quad, and Jet-ski must be at least 18 years of age.
  • Compliance: The Customer is responsible for ensuring they meet all legal requirements and hold the necessary documentation (e.g. a Category B driving licence for land activities; a Boat Operator’s Licence as required under the Regulations on the Operation of Boats and Yachts, Official Gazette 72/94 and amendments, for Jet-ski) as required by Croatian law.
  • Documentation: An original physical licence must be available for inspection at the location.
  • Liability Shift: The Customer assumes full legal and financial responsibility for any fines or penalties issued by maritime or traffic authorities due to a lack of proper documentation or breach of applicable regulations.

Safety and Age Restrictions

  • Drivers: Minimum age 18 years.
  • Passengers/Co-riders: No minimum age restriction applies to passengers. The driver and/or legal guardian assumes full responsibility for the safety of any minor passenger. For minor passengers, a written declaration from a parent or legal guardian is required and must be signed at the location before the activity.
  • Wibbit Water Park: Children under 7 years of age must be accompanied by an adult at all times.
  • Flyboard: Minimum age 14 years. Participants aged 14–17 require written parental consent before the activity.
  • Health & Sobriety: All activities are prohibited for pregnant women and persons with back or neck injuries. Consumption of alcohol or drugs before or during activities is strictly forbidden. The Merchant reserves the right to refuse participation to any person who appears to be under the influence.

Technical Issues and Replacements

  • Technical Failure: In the event of a mechanical failure of a vehicle or vessel not caused by the Customer, the Merchant will endeavour to provide a replacement to allow the activity to continue. If a replacement is not possible, a partial or full refund or voucher will be issued at the Merchant’s discretion.
  • Customer-Caused Damage: If the failure is attributable to reckless driving or failure to follow the guide’s instructions, no replacement or refund will be provided, and the Customer will be liable for documented repair costs.
  • Jet-skis are equipped with an automatic GPS power-restriction system. Full power is enabled only in designated safe zones. This restriction is a safety feature, not a technical fault.

Cancellation and Weather Policy

  • Strict No-Cancellation Policy: All bookings are final. No refunds or cancellations are permitted at the Customer’s request.
  • No-Show: Failure to arrive at the designated meeting point at least 15 minutes before the scheduled start time will result in total forfeiture of the booking and payment.
  • Merchant Cancellation: A full refund or reschedule will be offered exclusively if the Merchant cancels the activity due to adverse weather conditions or other safety concerns. The guide’s assessment is final in such matters.

Force Majeure

Neither party shall be held liable for failure or delay in performance of obligations due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, epidemics, pandemics, government restrictions, war, or civil unrest. In such cases, the Merchant will endeavour to offer a reschedule or voucher where possible.

Insurance and Conduct

  • Insurance: All Merchant vehicles and vessels are insured for third-party liability and passenger safety in accordance with applicable laws of the Republic of Croatia.
  • Conduct: Customers must follow all verbal and written instructions provided by the guide at all times. Failure to do so may result in immediate termination of the activity without refund.

Photography and Marketing

Consent to photography is not included in or implied by the booking. Photographs and video recordings of participants for promotional and marketing purposes are only taken with the Customer’s explicit, separate consent (by ticking the appropriate checkbox during the booking process). Customers who have not given consent must not be photographed or recorded for promotional use.

Consent may be withdrawn at any time by contacting erik.birgmajer@gmail.com. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

Governing Law and Jurisdiction

These Terms of Sale are governed by and construed in accordance with the laws of the Republic of Croatia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the Municipal Court in Pula, Croatia.

Complaints and Alternative Dispute Resolution

The Merchant will acknowledge receipt of every written complaint within 8 days of receipt, and provide a full response within 15 days of receipt, in accordance with the Croatian Consumer Protection Act (Official Gazette 19/22).

Consumers may also use the following alternative dispute resolution (ADR) mechanisms:

Minors — Parental/Guardian Consent

For all minor participants in activities (other than as passengers on land activities accompanied by an adult driver), written consent from a parent or legal guardian is mandatory. Consent is signed at the location before commencement of the activity. Without a signed consent form, the Customer will be offered a voucher or rescheduled booking, but not a refund.
